Terms of Use

The following terms, rules, and legal responsibilities constitute the User Agreement, which is recommended to be read before using Potteco Studio (“Site”). The purpose of these Terms of Use (hereinafter referred to as the “Agreement”) is to define the membership conditions for accessing the website www.pottecostudio.com
, its portals, and all services provided therein (hereinafter, you will be referred to as “User” or “Member”).

If you do not agree with the stated terms, please do not use the Potteco Studio site. By using the Site and filling out forms containing your personal information, you are deemed to have accepted the terms written on these pages.

 and operated by it. By using all services offered on the site, you acknowledge that you are bound by the following terms, that you are legally authorized and competent to enter into this agreement according to applicable law, are over 18 years of age, and have read and understood this Agreement.

 website is open to all members. Unless otherwise stated, services provided on the Site are free of charge.

The site management reserves the right to restrict a member’s access in the following situations and retains legal rights regarding individuals or entities involved in these actions:

1.1. Providing false, incomplete, misleading, or irregular information, or content contrary to public morals and Turkish laws.
1.2. Copying part or all of the site content without permission.
1.3. The User is directly responsible for any damage arising from sharing or misuse of login credentials (username, password) by third parties. Similarly, users may not use another person’s IP address, email, username, or other personal information, nor access or use other users’ private information without permission. Any legal or penal consequences resulting from such use are accepted by the User.
1.4. Using or attempting to use software or activities that threaten the site’s security or disrupt the functionality of the site or its software, including accessing, deleting, or altering information.

2. RESPONSIBILITIES

2.1. User information (visit time, duration, pages viewed) is tracked to provide better service.

2.2. A Potteco Studio user may begin using the site by completing the registration sections and confirming their email, provided they comply with the terms outlined in this Agreement.

2.3. Users agree to comply with the Turkish Penal Code, Turkish Commercial Code, Copyright and Intellectual Property Laws, relevant Decrees, Code of Obligations, other applicable regulations, and all announcements and notifications issued by www.pottecostudio.com
. Any legal, penal, or financial liability arising from non-compliance is the User’s responsibility.

2.4. Violation of obligations or general rules may result in temporary or permanent suspension of the User’s access or account closure.

2.5. Users may not interfere with other users’ access, upload programs to servers or databases to disrupt operations, or attempt fraud. Any violation may result in membership termination, and the User accepts all legal and penal responsibilities.

2.6. Users may not remove copyright, trademark, or intellectual property notices from copied or printed materials from the Site.

2.7. Membership cancellation and account deletion can be performed by the User through the Site. Once canceled, access to the Site will be revoked, and the User acknowledges this action is irreversible.

2.8. Relationships between users or with third parties are the responsibility of the individuals involved.

2.9. Certain sections of the Site may have specific rules. Users of these sections are deemed to accept these rules in advance.

2.10. Users should review the Privacy Policy and Disclosure Statement for measures taken to protect personal information and privacy.

2.11. Users acknowledge and guarantee that payment information (credit card, phone number, etc.) provided for purchases is accurate, and any legal or penal liability arising from this is the User’s responsibility.

3. TERMINATION OF AGREEMENT

3.1. This Agreement remains in effect until the User cancels membership or the Company terminates it. If the User violates any provision, the Company may unilaterally terminate the Agreement.

3.2. If a violation is detected, the Company will notify the User and request correction. If the User fails to correct the violation within 24 hours, the Company may suspend all or part of the User’s access until resolved.

3.3. The Company may immediately suspend services if:
a) it reasonably believes the User or another user’s activity may negatively affect other users or the Company’s network/servers;
b) unauthorized third-party access is suspected;
c) suspension is required to comply with applicable laws.
Suspension will be lifted once the underlying conditions are resolved, and the Company will inform the User of the reason unless prohibited by law.

4. PRIVACY

The Company prioritizes personal information and data security and takes all necessary precautions. Users agree to comply with these privacy provisions. These rules apply to all areas of the Site.

User information will not be used outside the purposes stated in this Agreement and will not be shared with third parties. Personal data may only be recorded and used for resolving system issues or conducting urgent fixes. IP addresses may be collected for statistical, demographic, and service improvement purposes without revealing User identity.

The Site may include links to third-party sites, display third-party ads, or direct Users to external services. The Company is not responsible for the privacy practices or content of such third-party applications or sites.

Exceptions to privacy obligations include:

Legal obligations;

Fulfillment of contractual obligations between the Company and Users;

Requests from authorized administrative or judicial authorities;

Protection of Users’ rights or security.

The Company undertakes to keep all confidential information secure, prevent unauthorized disclosure, and exercise due care in maintaining confidentiality. User responses to surveys may be used for marketing, statistical analysis, and database creation.

The Company may modify these privacy terms at any time. Updated provisions take effect upon publication on the Site.

5. FORCE MAJEURE

Neither party is responsible for non-performance caused by factors beyond control, including natural disasters, fire, explosions, wars, uprisings, mobilization, strikes, lockouts, pandemics, infrastructure or internet failures, and power outages (“Force Majeure”). Rights and obligations under this Agreement are suspended during such events.

6. SEVERABILITY AND ENFORCEABILITY

If any provision of this Agreement is partially or wholly invalid, the remainder shall continue to be valid and enforceable.

7. AMENDMENTS TO THE AGREEMENT

The Company may modify the services and terms of this Agreement, in whole or in part, at any time. Changes take effect upon publication on the Site. Users are responsible for monitoring updates, and continued use constitutes acceptance of changes.

8. EVIDENCE AGREEMENT

In any disputes arising from this Agreement, the Company’s books, records, computer data, and fax logs shall be considered valid evidence under Law No. 6100 on Civil Procedure. Users agree not to object to these records.

9. NOTIFICATION ADDRESSES

9.1. The Site does not require users’ postal addresses in advance. The email provided is considered the legal address for all notifications regarding this Agreement.

9.2. Users must notify the Company of changes to their email within 3 days; otherwise, notifications to the old email are valid.

9.3. Any notification sent by the Company is considered delivered 1 day after sending. Users acknowledge they have read, understood, accepted all terms, and confirmed the accuracy of their information.

10. DISPUTE RESOLUTION AND GOVERNING LAW

All disputes arising from the application or interpretation of this Agreement shall be subject to the jurisdiction of the Istanbul Anatolian Courthouse Courts and Enforcement Offices.

Registering as a member signifies acceptance of all terms in this Agreement. The Agreement takes effect mutually upon membership registration.
